Website Design & Build Agreement

How you agree to this: reply "I agree" to the quote email we sent you. That reply, together with the business name, what you chose and the price in the quote, is your signature. You do not need to print or sign anything.

These terms are between Levi Tozzer, trading as CXSites (contact@cxsites.com) — "we" — and the business named in your quote — "you".

This is a plain-English agreement. It says what we will build, what it costs, what we each have to do, and what happens if something goes wrong. If a sentence is unclear, ask before you agree — we would rather explain it now.

1. What we are building

Your quote says what you chose: how many pages, which extras, and how the site is looked after. A website is $1,200 for the first page — which can hold everything on one scrolling page — and $450 for each more page.

Translations (Spanish and other languages) are made automatically and are not proofread by a professional translator. If you spot a wording you want changed, tell us and we fix it.

The extras most businesses keep come ticked on your quote. You can untick any of them, on your quote page or by telling us, until your deposit is paid. After that you can still add extras at any time on your quote page: each one is paid when you add it, or added to your balance. Taking something off after the deposit is agreed in writing.

Looking after it. Your quote includes one of these:

Not included. Any of these can be added, but each is a separate written quote agreed before we start it: a live booking calendar or scheduling system; selling products online; customer logins; a blog or anything you update yourself; writing your copy from scratch; photography; ongoing SEO, ads or social media.

The deposit is due before we start building, and it is non-refundable — it reserves your build slot. The balance is due when you approve the finished site, before it goes live on your web address.

You pay on your quote page by debit or credit card, or any other option shown at checkout. Payments are processed by Stripe; we never see or keep your card number. A care plan or site plan paid by card renews each month until you cancel it, which you can do any time by telling us. We start the moment your deposit is paid. Invoices are due within 7 days. Overdue balances carry 1.5% interest per month.

Texas sales tax is added as a separate line where it applies.

If you do not already own a web address, one costs about $12–$20 a year and we bill it to you at cost. We never mark it up.

3. What you send us

Everything waits on this, so we keep it short. Most people send it the same day — it takes about fifteen minutes on a phone. Your quote email lists exactly what we need.

We show you a working site within 4 days of having both your material and your deposit — usually within 48 hours. Not a mockup: the real site, on a link you can open on your phone.

If we are still waiting on your material after 30 days, we pause the project and pick it up when you are ready. Your deposit stays valid for 6 months.

You confirm you have the right to use everything you send us. If a photo turns out to belong to someone else, that is your responsibility, not ours.

4. How long it takes

5. Changes

Two rounds of changes are included. A round is one message from you containing everything you want changed. Three separate emails over three days count as three rounds, so please gather it all up first — we will remind you.

Extra rounds are $150 each. Anything that adds a page or a feature not listed in section 1 is a new quote, not a change.

Fixing something we got wrong — a typo we introduced, a broken link, a layout broken on phones — is never a round. That is us finishing the job.

6. If you cancel

The deposit counts toward whatever is owed. We hold a build slot for you and turn down other work for it, which is what this covers.

Your first draft usually arrives within 48 hours of your deposit, so the first window is short in practice — if you are unsure about going ahead, tell us before you pay rather than after.

If we cancel — which we would only do if we could not deliver what we promised — we refund everything you have paid, including the deposit.

7. Who owns what

You own the finished site once it is paid for in full — the design, the code, the pages, and the text we wrote for you. Yours permanently, to keep or move anywhere. We hand over the code and the accounts.

Until the final payment arrives, we own it and it stays on our preview address.

We keep the right to show your site in our portfolio and to say we built it, unless you ask us in writing not to. Drafts, rejected concepts and our internal tools stay ours.

8. After it goes live

30 days of free fixes. If something we built does not work — a broken link, a form that stops emailing, a display problem — tell us and we fix it at no charge for 30 days after launch.

That covers our mistakes. It does not cover new content, new pages, price changes or seasonal updates.

Care plan — $199/month, optional, cancel any time: hosting, the security certificate, uptime monitoring, backups, and every small change you ask for, whenever you ask — new text, photos, prices, hours, a seasonal special, a new section on an existing page. We usually have it done the next business day. New pages and new features are not small changes; they are quoted like any other extra.

Without the care plan, a change is $150 per request. Put everything you want in one message and it counts as one request. No hourly billing, ever.

9. The honest limits

We build you a good, fast website. We cannot promise it will rank first on Google, bring a particular number of calls, or make a particular amount of money — nobody who tells you otherwise is being straight with you.

We are not liable for lost business, lost profit or knock-on losses. If something goes wrong and we are at fault, what you can recover from us is capped at what you paid us for this project.

We are not responsible for outages at your domain registrar, your email provider or the hosting platform, though we will help you chase them.
